Process service in India
We serve documents across major Indian cities for law firms, businesses, and individuals in Canada and elsewhere: legal notices, court papers in private suits, and documents sent from abroad. Each serve is attempted by a local process server and reported with the date, time, and GPS location.
What's different here
Serving documents in India
Court summons usually go through the court
In a civil suit, summons are generally issued and served through the court under Order V of the Code of Civil Procedure, 1908, which also lets a court allow the party to serve directly. We help where personal delivery by the party is allowed or needed, and with everything served outside a court process.
Legal notices
Many disputes start with a notice that the sender must deliver: a demand under section 138 of the Negotiable Instruments Act for a dishonoured cheque, a notice before suing a government body, or a contractual notice. We deliver them in person and give you a sworn record of when and to whom.
Documents from Canada and abroad
India is a party to the Hague Service Convention but objects to service through postal channels, so formal service of foreign court documents goes through India's Central Authority. Tell us what the foreign court needs and we will say plainly what we can and can't do.
Addresses and language
Addresses can be informal and landmarks matter. Give us everything you have, including a landmark and a phone number if you know one. Our servers work in English, Hindi, and the local language, and record what was said and understood.
The rules
Code of Civil Procedure, 1908 (Order V) and the Hague Service Convention
- In a civil suit, summons are generally issued and served through the court under Order V; a court may also allow the party to serve them directly.
- Many notices are served by the sender rather than the court, such as a demand notice for a dishonoured cheque under section 138 of the Negotiable Instruments Act, 1881.
- India is a party to the Hague Service Convention and objects to service by postal channels, so formal service of foreign court documents goes through its Central Authority.
